2. No Agency Relationship Created by Website Use

Use of this Site does not create a brokerage, fiduciary, client, or agency relationship of any kind. Such relationships are only established through a separate written agreement signed by both parties.

3. Property Listings and Accuracy

Property listings displayed on this Site may be sourced through MLS data feeds or third-party IDX platforms and are provided for general informational purposes only. Agent makes no warranty, express or implied, as to the completeness, accuracy, or timeliness of any listing information. You are solely responsible for independently verifying all property details before making any decisions.

IDX platforms used on this Site may independently collect user data, including search behavior and contact information, subject to their own terms of service and privacy policies. Agent does not control the data practices of IDX providers.

4. Acceptable Use

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited conduct includes, but is not limited to:

  • Attempting to access restricted or non-public areas of this Site
  • Reverse engineering, scraping, or copying Site content or code
  • Sending unsolicited commercial communications (spam)
  • Submitting false, misleading, or harmful content through any Site form

5. Third-Party Services and Links

This Site may include links to or integrations with third-party platforms, including IDX property search tools, mortgage calculators, and appointment scheduling services. These third parties operate independently and under their own privacy policies, which Agent does not control and does not endorse. Agent is not responsible for the data practices, content, or security of any third-party service.

6. Marketing Communications Consent (TCPA / CAN-SPAM)

By submitting your contact information through any form on this Site — including contact forms, home valuation requests, listing inquiry forms, or lead capture fields — you expressly consent to being contacted by Agent using the information you provide.

Specifically, you agree that Agent may contact you via:

  • Telephone calls (including calls placed using automated dialing technology)
  • Text/SMS messages (including messages sent using automated systems)
  • Email communications

These communications may be initiated or delivered through Agent's marketing and CRM platform, which is operated by GrowthSuite+ ("GS+"), a third-party real estate technology provider acting on Agent's behalf. The identity of the sending party in any communication will reflect Agent's branding and contact information.

This consent applies even if your number is listed on a federal, state, or internal Do Not Call registry.

You are not required to provide consent as a condition of purchasing or receiving any real estate services.

Message and data rates may apply for text messages. Estimated message frequency varies based on your inquiry and opt-in status.

To opt out:

  • Text messages: Reply STOP to any text message from Agent
  • Emails: Click the "Unsubscribe" link in any email
  • Calls: Verbally request removal during any call, or submit a written request using the contact information in Section 21
  • Internal Do Not Call list: To be added to Agent's internal Do Not Call list and excluded from future outbound calls regardless of registry status, submit a written request using the contact information in Section 21

Opt-out requests will be honored within a reasonable time, not to exceed 10 business days for texts and emails.

7. Categories of Data Collected

The following categories of personal information may be collected when you use this Site:

  • Contact information: Name, email address, phone number, mailing address
  • Property and service interests: Property type, price range, buying/selling timeline
  • Technical data: IP address, browser type, device type, operating system

8. Cookies, Tracking Technologies, and Ad Pixels

This Site uses cookies and similar tracking technologies to improve user experience, support website analytics, and track referral traffic. This may include the use of Google Analytics or comparable services.

This Site may also use advertising pixels, including but not limited to the Meta (Facebook) Pixel and Google Ads conversion tracking. Do Not Track (DNT) and Global Privacy Control (GPC): This Site does not currently honor DNT or GPC signals in an automated fashion. Agent reviews applicable state law requirements regarding GPC compliance on an ongoing basis and will update this policy as required.

9. How Your Information Is Used

10. Sharing of Information and Data Processing Infrastructure

Agent may share your personal information with trusted third-party service providers who assist with the operation of this Site and delivery of real estate services. These include:

  • CRM and marketing automation platform: Agent uses a customer relationship management (CRM) system provided by GrowthSuite+ (GS+), a third-party real estate technology and branding company. GS+ operates this CRM on Agent's behalf using GoHighLevel infrastructure and may process your contact data, manage communication workflows, and send automated text messages and emails as directed by Agent. GS+ acts as a data processor under Agent's instruction and is contractually prohibited from using your information for any purpose beyond delivering services to Agent.
  • GoHighLevel: This Site is hosted on and the CRM is built on the GoHighLevel platform. GoHighLevel serves as a sub-processor for both website hosting and CRM functionality and may have infrastructure-level access to data processed through this Site in the ordinary course of providing those services. GoHighLevel operates under its own terms of service and privacy policy.
  • IDX / property search platforms: To facilitate property search functionality on this Site. IDX platforms may independently collect and process user data subject to their own privacy policies.
  • Advertising platforms: If Agent runs paid advertising campaigns (including Meta/Facebook or Google Ads), those platforms may receive conversion and behavioral data through pixel integrations on this Site, subject to their own privacy policies.
  • Email service providers: For delivery of communications you have consented to receive
  • Website security providers: To maintain Site uptime and protect against unauthorized access

Agent does not sell, rent, or trade your personal information to any third party for their own marketing purposes.

11. SMS Messaging Program Disclosure

If you opt in to receive SMS communications from Agent, those messages are sent through Agent's CRM platform operated by GS+ on GoHighLevel infrastructure. Message frequency varies. Standard message and data rates may apply.

Supported carriers are not liable for delayed or undelivered messages. To opt out at any time, reply STOP to any message. For help, reply HELP or contact Agent using the information in Section 21.

12. Call Tracking and Recording

This Site may use call tracking numbers provided through Agent's CRM platform to measure marketing performance. Calls placed to tracking numbers may be recorded for quality and training purposes. Where required by applicable law, callers will be notified of recording at the start of the call.

13. Data Retention

Personal information will be retained only for as long as necessary to fulfill the purposes described in this Policy, or as required by applicable law or professional licensing obligations. Upon receipt of a valid data deletion request, Agent will comply within a reasonable time, subject to any legal or contractual retention requirements.

14. Data Security and Breach Notification

Agent and GrowthSuite+ (GS+) use reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, or misuse. However, no internet-based system is completely secure, and neither Agent nor GS+ can guarantee absolute security.

In the event of a data breach that materially affects your personal information, Agent will notify affected individuals in accordance with applicable state breach notification law.

Agent is not liable for data breaches or security incidents occurring within GoHighLevel's core infrastructure or other third-party platforms that are outside of Agent's and GS+'s direct control.

15. Children's Privacy

This Site is not directed to children under the age of 13. Agent does not knowingly collect personal information from children. If Agent becomes aware that personal information from a child under 13 has been collected, it will be promptly deleted.

16. Accessibility

Agent is committed to ensuring this Site is accessible to individuals with disabilities. If you experience difficulty accessing any content on this Site or require content in an alternative format, please contact Agent using the information in Section 21. Agent will make reasonable efforts to accommodate your request.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Agent shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of this Site or reliance on any content herein. Agent is not liable for the acts or omissions of GoHighLevel's core infrastructure or other third-party platforms outside of Agent's or GS+'s direct control. Nothing in this section limits liability for damages caused directly by Agent's own negligence or willful misconduct.

18. About This Website and Platform

This Site was designed and developed by GrowthSuite+ (GS+), a third-party real estate branding and technology company, and is hosted on the GoHighLevel platform. GS+ also provides Agent with CRM and marketing automation services, operating Agent's CRM account on GoHighLevel infrastructure, which may be used to send automated communications to contacts who have submitted information through this Site.

All content, branding, and communications presented through this Site and associated CRM reflect Agent's own real estate services and are published and transmitted under Agent's direction and authority. Agent retains full responsibility for the accuracy of all published content, the lawful use of CRM and communication tools, and the ongoing compliance of this Policy with applicable law.

19. Governing Law and Jurisdiction

This Policy is governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising from use of this Site must be brought in a court of competent jurisdiction in Cook County, Texas.

20. Updates to This Policy

Agent reserves the right to modify this Policy at any time. Updates will be posted on this page with a revised "Last Reviewed" date and will take effect immediately upon publication. Continued use of this Site following any update constitutes your acceptance of the revised terms. Users are encouraged to review this page periodically.

Texas Residents — Additional Privacy Rights and Disclosures

This addendum applies to residents of the State of Texas and supplements the Core Policy above. In the event of a conflict between this addendum and the Core Policy, this addendum controls for Texas residents.

Texas Data Privacy and Security Act (TDPSA)

To the extent Agent qualifies as a "controller" under the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541), Texas residents have the following rights:

  • Right to Access: Request confirmation of whether Agent is processing your personal data and obtain a copy of that data
  • Right to Correction: Request correction of inaccurate personal data Agent holds about you
  • Right to Deletion: Request deletion of personal data Agent has collected about you, subject to legal retention obligations
  • Right to Data Portability: Request a copy of your personal data in a portable, readily usable format
  • Right to Opt Out: Opt out of the processing of your personal data for purposes of targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects
  • Right to Appeal: If Agent declines to act on your request, you may appeal that decision by contacting Agent in writing. Agent will respond to appeals within the timeframe required by applicable law

To exercise any of these rights, contact Agent using the information in Section 21 above. Agent will respond within 45 days of receiving a verifiable request, with a possible 45-day extension where reasonably necessary.

Texas Breach Notification

In the event of a breach of security involving your sensitive personal information, Agent will provide notice as required under the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. & Com. Code § 521.053), without unreasonable delay following discovery of the breach.

Do Not Track

Texas law does not currently require this Site to respond to Do Not Track (DNT) signals. This Site does not currently honor DNT signals.


California Residents — Additional Privacy Rights and Disclosures

This addendum applies to residents of the State of California and supplements the Core Policy above. It is intended to comply with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), Cal. Civ. Code § 1798.100 et seq. In the event of a conflict between this addendum and the Core Policy, this addendum controls for California residents.

Disclosure of Personal Information

Agent does not sell personal information. Agent may share personal information with service providers (GS+, GoHighLevel, IDX platforms, advertising platforms) as described in Section 10 of the Core Policy for business purposes only.

Agent may share behavioral data with advertising platforms (Meta, Google) through pixel integrations for targeted advertising purposes. California residents have the right to opt out of this sharing.

Your California Privacy Rights

California residents have the following rights under the CPRA:

  • Right to Know: Request disclosure of the categories and specific pieces of personal information Agent has collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom it is shared
  • Right to Delete: Request deletion of personal information Agent has collected about you, subject to certain exceptions
  • Right to Correct: Request correction of inaccurate personal information
  • Right to Opt Out of Sale or Sharing: Opt out of the sale or sharing of your personal information for cross-context behavioral advertising. To exercise this right, click the "Do Not Sell or Share My Personal Information" link in the footer of this Site or contact Agent using the information in Section 21 above
  • Right to Limit Use of Sensitive Personal Information: Agent does not collect sensitive personal information as defined under the CPRA
  • Right to Non-Discrimination: Agent will not discriminate against you for exercising any of your California privacy rights
  • Right to Appeal: If Agent declines to act on your request, you may appeal in writing. Agent will respond within the timeframe required by applicable law

How to Submit a California Privacy Request

To submit a verifiable consumer request, contact Agent using the information in Section 21 above. Agent will respond within 45 days of receiving a verifiable request. If more time is required, Agent will notify you of the extension and the reason within the initial 45-day period. Responses to verified requests are provided free of charge, up to twice per calendar year.

Global Privacy Control (GPC)

California law requires businesses subject to the CPRA to honor Global Privacy Control (GPC) signals as a valid opt-out of sale or sharing of personal information. Agent is reviewing GPC implementation and will update this policy upon completion. If you use a GPC-enabled browser, please also submit an opt-out request directly using the contact information in Section 21 until automated GPC honoring is confirmed.

California Breach Notification

In the event of a security breach affecting your personal information, Agent will notify affected California residents as required under California Civil Code § 1798.82, without unreasonable delay and in the most expedient time possible.
